1. Introduction
Welcome to UniversalResourceGrove ("we," "our," or "us"). These Terms & Conditions ("Terms") apply to your use of our yacht charter services and our website at universalresourcegrove.sbs (the "Service") provided by UniversalResourceGrove.
When you reserve a charter or use our Service, you accept these Terms. Should you reject any part of the terms, you will no longer have access to the Service.
2. Service Overview
UniversalResourceGrove offers top-tier yacht charter services which include an array of options such as:
- Day trips on yachts
- Evening sea voyages
- Company offsites
- Exclusive gatherings
- Extended sailing experiences
Our services are dependent on vessel availability and subject to the influence of weather. We may change or stop services at our sole discretion.
3. Booking and Reservations
3.1 Booking Process
Charter booking prerequisites include:
- A minimum age of 18 years
- Submission of accurate and comprehensive details
- Payment of a specified deposit as per your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A booking is considered confirmed after we have received your payment and issued a written confirmation. Service may be denied at our sole determination.
3.3 Availability
Charter availability is contingent on the vessel's availability and appropriate weather conditions. We'll attempt to honor your requested charter dates and times wherever possible.
4. Payment Terms
4.1 Pricing
Prices are given in € and incorporate all applicable taxes unless stated otherwise. Prices are subject to alteration without prior notification.
4.2 Payment Schedule
- Initial Deposit: 50% of the entire charter fee is due upon reservation
- Remaining Balance: Payable 48 hours before the charter's scheduled departure
- Any additional fees: Payable at the end of the charter
4.3 Payment Methods
We accept most credit cards, electronic fund transfers, and certified cheques. Payments are processed using encrypted and secure systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancellation occurs over 72 hours before departure: Full reimbursement minus transaction charges
- Between 24 to 72 hours before departure: Half refund
- Under 24 hours before departure: Non-refundable
5.2 Weather Cancellations
In case our captain deems weather conditions to be unsafe, we will suggest:
- Rescheduling your charter to an upcoming date at no supplementary charge
- Issuing a complete refund when rescheduling isn't feasible
5.3 Mechanical Issues
If your designated vessel experiences technical issues, we will make an effort to supply a suitable alternative. If an alternative is not available, a full reimbursement will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to the instructions of the crew
- Utilize safety gear when deemed necessary
- Inform about any medical conditions that could affect their safety
- Stay within approved areas on the vessel
6.2 Prohibited Items
The following are not permitted on the vessel:
- Containers made of glass
- Illegal substances
- Firearms or other weaponry
- Excessive non-alcoholic beverages beyond a reasonable quantity for consumption
- Animals (unless given prior authorization)
6.3 Conduct
Passengers should behave respectfully at all times. We reserve the right to discontinue a charter without issuing a refund if a passenger's conduct endangers safety or interferes with others’ enjoyment.
7. Liability and Insurance
7.1 Our Liability
Our accountability is limited to the fee you paid for the charter. We are not liable for:
- Injuries sustained due to guest negligence
- Theft or destruction of personal belongings
- Indirect or punitive losses
- Delays resulting from weather or factors beyond our influence
7.2 Insurance Coverage
Comprehensive maritime insurance is maintained for our fleet and operations. Guests are responsible for securing their travel and personal insurance.
7.3 Assumption of Risk
By participating in a charter, you recognize that boating activities come with inherent hazards and take on personal responsibility for your security and health.
8. Modifications and Itinerary Changes
We retain the authority to adjust routes, timelines, or itineraries due to factors including weather, safety measures, or operational necessities. We will strive to provide similar experiences when changes occur.
9. Force Majeure
Events outside our control, such as extreme weather, natural disasters, legal impositions, port shutdowns, and mechanical breakdowns, will absolve us of responsibility for delays, cancellations, or changes.
10. Privacy and Data Protection
Your personal data is managed in line with our Privacy Policy. With the use of our services, you consent to our data gathering and usage as outlined in our Privacy Policy.
11. Intellectual Property
The material on our site, which includes texts, graphics, trademarks, and images, is under copyright and trademark protection. Unauthorized copying, distribution, or creative works are prohibited without our explicit consent.
12. Governing Law
These Terms are under the jurisdiction of the laws in Monaco. Disputes shall be dealt with in the courts of Monte Carlo, Monaco.
13. Changes to Terms
We may revise these Terms at any time. Amendments will be posted on the website with a notation of the date of revision. Continued service utilization signifies acceptance of the changed terms.
